CONGRESSMAN JOE MORELLE HIGHLIGHTS IMPACT OF OVERTURNING CHEVRON

July 24, 2024

“In an instant, the conservative majority in the Supreme Court substituted its policymaking judgment for the elected branches of government. The American people will suffer as a result.”

(Washington, D.C.)—Today, Congressman Joe Morelle highlighted yesterday’s hearing of the Committee on House Administration, which discussed the far-reaching impact of the recent Supreme Court decision in Loper Bright Enterprises v. Raimondo and the overturning of the Chevron doctrine. The Chevron doctrine set the longstanding precedent that Congress and the executive branch should be the primary policymakers in government.

The recent decision to overturn the 40-year doctrine set in Chevron v. Natural Resources Defense Council will threaten existing regulations that ensure the safety of the cars we drive, the quality of the air we breathe, and the cleanliness of the water we drink.

“Let’s be crystal clear: this decision did not empower Congress. It empowered the conservative majority on the Supreme Court, and a legion of Federalist Society-vetted lower court judges, to make extreme and ill-informed decisions impacting every American’s daily life. Further, the decision is a tremendous gift to the wealthy and special interests,” said Rep. Morelle during the Committee on House Administration’s full committee hearing entitled, “Congress in a Post-Chevron World.”

Policymaking in Congress will be even more influenced by wealthy lobbyists and special interest groups. Prior to this decision, the bipartisan Select Committee on Modernization’s efforts and research emphasized the need for Congress to increase the institution’s resources, capacity, and expertise.
